- Component 2

What is common law as a source of the constitution?
Questions from this subtopic
Each one with the model answer underneath.
- 1
Name the five main sources of the UK constitution.
Model answer
Statute law, common law, conventions, authoritative works and treaties.
- 2
What is statute law, and why is it the most important constitutional source?
Model answer
Law made by Act of Parliament. It ranks above the other sources because parliamentary sovereignty means an Act can override a convention, reverse a judicial ruling or give effect to a treaty.
- 3
Give two examples of statutes that carry constitutional weight.
Model answer
The Human Rights Act 1998, which brought European Convention rights into UK law, and the Constitutional Reform Act 2005, which created the Supreme Court. Devolution statutes such as the Scotland Act 1998 are a further example.
- 4
What is common law as a source of the constitution?
Model answer
Legal principle built up through the decisions of judges in individual cases, where each ruling becomes a precedent binding on lower courts. Much of the protection of civil liberties in the UK originated this way rather than in legislation.
- 5
Give an example of a constitutional principle established through common law.
Model answer
The royal prerogative is defined by the courts rather than by statute, and judicial review — the power of the courts to quash unlawful executive action — was itself developed by judges rather than granted by Parliament.
- 6
What is a constitutional convention?
Model answer
An established practice that is treated as binding by those who operate the constitution, but which no court will enforce. Its authority rests on precedent and political consequence rather than on law.
