What you need to know
Answer each one before you reveal it.
What is the difference between redundancy and dismissal for misconduct?
Questions from this subtopic
Each one with the model answer underneath.
- 1
What is meant by redundancy?
Model answer
It is dismissal because the job itself has ceased to exist, for example when a workplace closes or the business needs fewer employees to do that kind of work.
- 2
What is the difference between redundancy and dismissal for misconduct?
Model answer
In redundancy the post disappears and nothing is alleged against the employee, whereas dismissal for misconduct is a judgement about the individual's own behaviour.
- 3
Distinguish between voluntary and compulsory redundancy.
Model answer
In voluntary redundancy employees are invited to apply to leave, usually with enhanced pay, while in compulsory redundancy the employer selects who must go.
- 4
Give one drawback for a business of relying on voluntary redundancy.
Model answer
The employees most confident of finding other work tend to volunteer, so the business can lose exactly the skilled staff it most wanted to keep.
- 5
What makes a redundancy selection process fair?
Model answer
The employer must use objective criteria applied consistently, such as skills, attendance or performance records, and must consult employees before decisions are confirmed.
- 6
Name two selection criteria for redundancy that would be unlawful.
Model answer
Selecting employees because they are pregnant or because they belong to a trade union would be unlawful.
