  1. 1

Give three criticisms of the Court's political power.

    Model answer

Justices are unelected and unaccountable, hold office for life, and effectively make policy on contested moral and social questions that elected bodies should settle.

  2. 2

Give three arguments that the Court's power is exaggerated.

    Model answer

It cannot initiate cases and must wait for litigation, it commands neither money nor enforcement machinery, and its rulings can be undone by amendment, by new legislation or by a later Court.

  3. 3

How can Congress and the states reverse a constitutional ruling of the Supreme Court?

    Model answer

By passing a constitutional amendment, which has occasionally been done to overturn a decision the country would not accept.

  4. 4

How can Congress reverse a Supreme Court ruling that interprets a statute rather than the Constitution?

    Model answer

It can simply legislate again, rewriting the statute to make its intention explicit.

  5. 5

Name three other checks on the Supreme Court.

    Model answer

The president's power of nomination, the Senate's power of confirmation, and Congress's authority to set the Court's size and much of its jurisdiction.

  6. 6

What was Franklin D. Roosevelt's court-packing plan, and what happened to it?

    Model answer

In 1937 he proposed enlarging the Court to overcome its hostility to the New Deal; Congress refused, but the Court thereafter began upholding his programme.
