Questions from this subtopic
Each one with the model answer underneath.
- 1
What is a means test?
Model answer
A means test is an assessment of the applicant's income and capital to determine whether they can reasonably be expected to pay for legal services themselves.
- 2
What is meant by passporting in the means test?
Model answer
A person receiving specified income-related benefits is automatically treated as satisfying the income element of the test, although their capital may still be assessed.
- 3
What is a contribution?
Model answer
Where an applicant's means fall between the free limit and the upper limit, funding is granted but the applicant must pay a monthly sum out of income or a lump sum out of capital.
- 4
Why is the treatment of capital in the means test criticised?
Model answer
Equity in a home is counted as capital, so a person with a very low income but an owned house may be refused help even though they have no money available to spend on lawyers.
- 5
What is the merits test?
Model answer
The merits test assesses whether the case is strong enough and important enough to justify the use of public money on it.
- 6
How do prospects of success affect a grant of civil legal aid?
Model answer
Funding is normally refused unless the prospects of success reach at least a moderate level, and a case assessed as poor is refused outright.
