Questions from this subtopic
Each one with the model answer underneath.
- 1
What is meant by overruling?
Model answer
Overruling is a court declaring that a legal rule laid down in an earlier and different case is wrong, so that the rule ceases to be law for the future and for past events alike.
- 2
What is meant by reversing?
Model answer
Reversing is an appeal court changing the outcome of the very case before it, allowing the appeal and substituting a different decision for that of the court below.
- 3
Distinguish overruling from reversing.
Model answer
Overruling concerns a rule established in an earlier, separate case, while reversing concerns the decision in the same case as it moves up on appeal.
- 4
What is meant by distinguishing?
Model answer
Distinguishing is a court finding a material difference between the facts before it and those of an apparently binding case, so that the earlier ratio does not apply.
- 5
Illustrate distinguishing using Balfour v Balfour (1919) and Merritt v Merritt (1970).
Model answer
Balfour held that a domestic arrangement between a couple living together was not intended to create legal relations, and Merritt was distinguished because the couple were already separated and put their agreement in writing, so it was enforceable.
- 6
Why is distinguishing the most frequently used avoidance technique?
Model answer
It allows a court to avoid an unwelcome precedent without claiming any authority to abolish it, so unlike overruling it is available to every court in the hierarchy.
