What was decided in R (Jackson) v Attorney General (2005)?
Questions from this subtopic
Each one with the model answer underneath.
- 1
Define parliamentary sovereignty.
Model answer
Parliamentary sovereignty means Parliament may make or unmake any law whatever, no Parliament may bind its successors, and no court may set aside an Act of Parliament.
- 2
What did Ellen Street Estates v Minister of Health (1934) settle about entrenchment?
Model answer
The Court of Appeal held that a later Act impliedly repeals an earlier inconsistent one, so Parliament cannot entrench a statute against repeal by a future Parliament.
- 3
What did Laws LJ hold in Thoburn v Sunderland City Council (2002) about constitutional statutes?
Model answer
He held that a category of constitutional statutes, such as the European Communities Act 1972, cannot be impliedly repealed and can be repealed only by express words.
- 4
What was decided in R (Jackson) v Attorney General (2005)?
Model answer
The House of Lords upheld the validity of the Hunting Act 2004, confirming that a measure passed under the Parliament Acts 1911 and 1949 is a genuine Act of Parliament and not delegated legislation.
- 5
How did the Parliament Acts 1911 and 1949 alter the power of the House of Lords?
Model answer
They allow a bill to receive Royal Assent without the consent of the Lords after a delay, reduced by the 1949 Act to one year and two sessions, and after only one month in the case of a money bill.
- 6
How did membership of the European Union qualify parliamentary sovereignty?
Model answer
While the European Communities Act 1972 was in force the courts disapplied provisions of Acts of Parliament that conflicted with directly effective European law, as the House of Lords did with the Merchant Shipping Act 1988 in Factortame (No 2) (1991).
