Questions from this subtopic
Each one with the model answer underneath.
- 1
What is a Welsh statutory instrument?
Model answer
A Welsh statutory instrument is secondary legislation made by the Welsh Ministers, under power in an Act of Parliament or an Act of the Senedd, and it applies in Wales.
- 2
Why did Wales rely almost entirely on secondary legislation between 1999 and 2007?
Model answer
The Government of Wales Act 1998 conferred only executive functions and the power to make secondary legislation, so the National Assembly could fill in detail under Westminster statutes but could not pass its own primary law.
- 3
What was an Assembly Measure?
Model answer
An Assembly Measure was a form of primary legislation available to the National Assembly between 2007 and 2011 under Part 3 of the Government of Wales Act 2006, made only on matters transferred to it.
- 4
How does the Senedd control secondary legislation made by Welsh Ministers?
Model answer
Welsh statutory instruments are laid before the Senedd under affirmative or negative procedure as the enabling Act requires, and a Senedd committee reports on their technical propriety before they are debated.
- 5
Which Senedd committee scrutinises delegated legislation in Wales?
Model answer
The Legislation, Justice and Constitution Committee examines Welsh statutory instruments and reports on drafting, vires and any matter requiring the Senedd's attention.
- 6
Why does a single Westminster Act sometimes give the same power to a Secretary of State and to the Welsh Ministers?
Model answer
Where the subject is devolved in Wales but not in England, the Act names each authority separately so each may make regulations for its own territory.
