Questions from this subtopic
Each one with the model answer underneath.
- 1
Explain the criticism that appropriation has been stretched too far.
Model answer
After Gomez and Hinks almost any dealing with property counts as an appropriation, even conduct the owner consented to, so the boundary of the offence depends almost entirely on dishonesty.
- 2
Why is it troubling that theft can be committed by accepting a valid gift?
Model answer
The criminal law contradicts the civil law, because the recipient becomes the lawful owner and yet may be convicted of stealing the very thing they now own.
- 3
Give one argument in defence of the wide meaning of appropriation.
Model answer
A wide external element with a dishonesty filter catches exploitation of vulnerable owners that a narrow, technical definition would let through.
- 4
Explain the criticism that dishonesty is left to the jury.
Model answer
There is no legal definition of dishonesty, so different juries can reach different conclusions on similar facts and the outcome depends on the community standard each jury applies.
- 5
Give one argument for leaving dishonesty to the jury.
Model answer
Dishonesty is a moral judgment that shifts with social attitudes, and a jury of ordinary people is better placed to make it than a fixed statutory formula.
- 6
What improvement did Ivey v Genting Casinos (2017) make to the law?
Model answer
It aligned the criminal test with the civil one and removed a limb that allowed a defendant with distorted standards to argue they had not realised the conduct was dishonest.
