Name three ancillary orders a criminal court may make.
Questions from this subtopic
Each one with the model answer underneath.
- 1
State the custody threshold.
Model answer
A court may pass a custodial sentence only where the offence, or the combination of the offence and others associated with it, is so serious that neither a fine alone nor a community sentence can be justified.
- 2
What is a suspended sentence?
Model answer
A suspended sentence is a term of imprisonment that the offender does not serve provided they commit no further offence and comply with any requirements during the operational period, and it is activated if they do not.
- 3
Name four requirements that may be attached to a community order.
Model answer
Unpaid work, a curfew with electronic monitoring, a rehabilitation activity requirement and a drug or alcohol treatment requirement may all be imposed.
- 4
How is the level of a fine decided?
Model answer
The court fixes a band reflecting the seriousness of the offence and then calculates the fine as a proportion of the offender's weekly income, so the same offence produces different figures for different offenders.
- 5
Distinguish an absolute discharge from a conditional discharge.
Model answer
An absolute discharge imposes no penalty at all, while a conditional discharge imposes none unless the offender commits a further offence within a period set by the court, when they may be sentenced for the original offence as well.
- 6
Name three ancillary orders a criminal court may make.
Model answer
A compensation order to the victim, disqualification from driving, and a restraining order protecting a named person are all ancillary orders.
