Questions from this subtopic
Each one with the model answer underneath.
- 1
What is meant by alternative dispute resolution?
Model answer
It means any method of resolving a civil dispute otherwise than by a trial, including negotiation, mediation, conciliation and arbitration.
- 2
What is negotiation?
Model answer
Negotiation is direct discussion between the parties or their solicitors aimed at agreement; it is private, costs nothing beyond their own time, and settles the great majority of disputes.
- 3
What is mediation?
Model answer
Mediation is a process in which a neutral third party helps the parties to reach their own agreement, carrying proposals between them and testing each side's position, without ever imposing a decision.
- 4
What is conciliation?
Model answer
Conciliation is a process in which the neutral third party takes a more active role than a mediator, evaluating the dispute and suggesting terms of settlement that the parties remain free to reject.
- 5
Distinguish mediation from arbitration.
Model answer
A mediator helps the parties to reach their own agreement and decides nothing, whereas an arbitrator hears the dispute and imposes a binding award on them.
- 6
Is the outcome of a mediation binding on the parties?
Model answer
Not of itself; it becomes binding when it is recorded in a settlement contract, and it can be enforced directly if the parties turn it into a consent order of the court.
