Questions from this subtopic

Each one with the model answer underneath.

  1. 1

What is meant by the doctrine of ultra vires?

    Model answer

The doctrine means beyond the powers, and it renders delegated legislation void where the maker has gone outside the authority the enabling Act conferred.

  2. 2

Distinguish procedural ultra vires from substantive ultra vires.

    Model answer

Procedural ultra vires is a failure to follow a mandatory procedure laid down in the enabling Act, while substantive ultra vires is making a rule about something the Act never authorised.

  3. 3

What did the Aylesbury Mushrooms case (1972) decide?

    Model answer

A training board order was ineffective against mushroom growers because the minister had failed to consult their representative association as the enabling Act required, a clear case of procedural ultra vires.

  4. 4

What did Attorney General v Fulham Corporation (1921) establish?

    Model answer

A council empowered to provide wash-houses where residents could do their own washing acted ultra vires when it ran a paid laundry service instead, because the power did not extend to that activity.

  5. 5

What did the Fire Brigades Union case (1995) decide about a minister's use of delegated power?

    Model answer

The House of Lords held that the Home Secretary could not introduce a compensation tariff by executive act in a way that was inconsistent with a statutory scheme Parliament had enacted, even though that scheme had not been brought into force.

  6. 6

On what ground was the by-law in Strickland v Hayes Borough Council (1896) held void?

    Model answer

It was drawn far more widely than was needed to deal with the mischief and would have caught conduct causing no annoyance to anyone, so it was unreasonable and beyond the power to make by-laws.
