Questions from this subtopic
Each one with the model answer underneath.
- 1
What is specific performance?
Model answer
Specific performance is an equitable order compelling a party to carry out its obligations under the contract rather than pay damages for failing to do so.
- 2
What is the primary condition for an order of specific performance?
Model answer
Damages must be an inadequate remedy, so the order is available only where money cannot properly compensate the claimant for not receiving the performance itself.
- 3
Why is specific performance readily granted in contracts for the sale of land?
Model answer
Every piece of land is regarded as unique, so a disappointed buyer cannot obtain an equivalent elsewhere and damages cannot replace what was promised.
- 4
When will a court order specific performance of a contract for the sale of goods?
Model answer
Section 52 of the Sale of Goods Act 1979 gives the court a discretion to order delivery of specific or ascertained goods, and it is used where the goods are unique or otherwise unobtainable rather than ordinary market commodities.
- 5
Why was specific performance granted in Beswick v Beswick (1968)?
Model answer
The estate had suffered only nominal loss, so damages would have allowed the nephew to keep the business and pay nothing, and specific performance of the promise to pay the widow her annuity was the only just outcome.
- 6
Why will a court not order specific performance of a contract of personal service?
Model answer
Compelling a person to work for another approaches forced labour, the relationship depends on mutual confidence which the court cannot restore, and the quality of unwilling performance could never be supervised.
