Questions from this subtopic

Each one with the model answer underneath.

  1. 1

How common is trial by jury in civil cases?

    Model answer

It is very rare, accounting for well under one per cent of civil trials, so almost every civil case is decided by a judge sitting alone.

  2. 2

Which statute governs the right to a jury in the High Court in civil cases?

    Model answer

Section 69 of the Senior Courts Act 1981 sets out when a party may insist on trial by jury in the King's Bench Division.

  3. 3

In which civil claims does a right to jury trial survive?

    Model answer

It survives in claims for fraud, malicious prosecution and false imprisonment, unless the trial would require a prolonged examination of documents or accounts.

  4. 4

Which civil claim lost its presumption of jury trial in 2013?

    Model answer

Defamation lost it, because section 11 of the Defamation Act 2013 made trial without a jury the default in libel and slander actions.

  5. 5

Why was jury trial removed as the default in defamation?

    Model answer

Libel trials with juries were long and costly, the jury gave no reasons and could not rule on the meaning of the words, and allowing a judge to decide meaning early disposes of many claims without a trial.

  6. 6

How many jurors sit in a civil case in the High Court and in the County Court?

    Model answer

Twelve jurors sit in the High Court and eight sit in the County Court.
