Questions from this subtopic
Each one with the model answer underneath.
- 1
What distinguishes involuntary manslaughter from murder?
Model answer
Involuntary manslaughter is an unlawful killing committed without the intention to kill or to cause grievous bodily harm, so the mens rea of murder is absent.
- 2
Name the two main forms of involuntary manslaughter.
Model answer
Unlawful act manslaughter, also called constructive manslaughter, and gross negligence manslaughter.
- 3
State the four elements of unlawful act manslaughter.
Model answer
The defendant must do an act unlawful in the criminal sense, the act must be objectively dangerous, it must cause the death, and the defendant must have the mens rea for the unlawful act.
- 4
Must the unlawful act be a crime rather than a civil wrong?
Model answer
Yes, a tort or a breach of contract will not do, and R v Franklin (1883) established that the act must be criminally unlawful.
- 5
State the test of dangerousness in unlawful act manslaughter.
Model answer
R v Church (1966) asks whether all sober and reasonable people would inevitably recognise that the act carried a risk of some harm, albeit not serious harm.
- 6
Does the defendant have to foresee the risk of harm?
Model answer
No, DPP v Newbury and Jones (1976) confirmed that the test is objective, so the defendant need not have foreseen any harm at all.
