- 3 things to know
- A2 Units 3 and 4
Overview
Recall questions on the fate of an incompatible Senedd Act, section 29 of the Scotland Act, the Belfast Agreement, the Sewel convention, the 2015 asbestos reference, and the Welsh language.
What you need to know
Answer each one before you reveal it.
What restriction does the Government of Wales Act 2006 place on Welsh Ministers in relation to Convention rights?
What does the Northern Ireland Act 1998 provide about Assembly legislation and Convention rights?
Questions from this subtopic
Each one with the model answer underneath.
- 1
Under the Government of Wales Act 2006, what is the position of a Senedd Act that is incompatible with a Convention right?
Model answer
It falls outside the Senedd's legislative competence and is not law to the extent of the incompatibility, so a court may set it aside.
- 2
Why does an incompatible Act of the United Kingdom Parliament remain law when an incompatible Senedd Act does not?
Model answer
An Act of Parliament remains valid and enforceable and can attract only a declaration of incompatibility, because Parliament is sovereign while a devolved legislature holds only the powers a statute has conferred.
- 3
What restriction does the Government of Wales Act 2006 place on Welsh Ministers in relation to Convention rights?
Model answer
Welsh Ministers have no power to make subordinate legislation, or to do any other act, that is incompatible with the Convention rights.
- 4
What does section 29 of the Scotland Act 1998 provide about Convention rights?
Model answer
Section 29 provides that a provision of an Act of the Scottish Parliament is outside legislative competence, and so is not law, if it is incompatible with the Convention rights.
- 5
What does the Northern Ireland Act 1998 provide about Assembly legislation and Convention rights?
Model answer
Section 6 places an incompatible provision outside the Assembly's legislative competence, so it never becomes law.
- 6
Why does the Belfast (Good Friday) Agreement 1998 matter to any proposal to repeal the Human Rights Act 1998?
Model answer
The Agreement committed the United Kingdom to incorporating the Convention into Northern Ireland law with direct access to the courts and remedies for breach, so repeal engages an international commitment as well as a domestic statute.
