Questions from this subtopic

Each one with the model answer underneath.

  1. 1

    What is judicial review?

    Model answer

Judicial review is the process by which the High Court examines the lawfulness of a decision, action or failure to act of a body exercising a public function.

  2. 2

What is the difference between review and appeal?

    Model answer

An appeal reconsiders the merits and can substitute a different decision, whereas review examines only the legality of the decision-making and normally sends the matter back to be decided again.

  3. 3

Which court hears a claim for judicial review?

    Model answer

The Administrative Court, part of the King's Bench Division of the High Court, which sits in Cardiff as well as at other centres in England and Wales.

  4. 4

What is the permission stage in judicial review?

    Model answer

A claim cannot proceed without the court's permission, which filters out claims that are unarguable, brought out of time, or brought by someone without standing.

  5. 5

What time limit applies to a claim for judicial review?

    Model answer

The claim must be brought promptly and in any event within three months of the grounds arising, with shorter limits in planning and public procurement cases.

  6. 6

What standing must a claimant for judicial review show?

    Model answer

A sufficient interest in the matter to which the claim relates, a test the courts have interpreted generously.
