- 3 things to know

Questions from this subtopic
Each one with the model answer underneath.
- 1
Compare the legal source of executive power in the two systems.
Model answer
Irish executive power is conferred by the Constitution and exercised by or on the authority of the Government. Much United Kingdom executive power derives from the royal prerogative, exercised by ministers in the monarch's name, alongside powers granted by statute.
- 2
What is the royal prerogative?
Model answer
The royal prerogative is the body of powers historically belonging to the Crown and now exercised by ministers, covering matters such as making treaties, deploying the armed forces, granting honours and issuing passports. Prerogative powers are not set out in any single document.
- 3
Why is prerogative power considered less transparent than the Irish model?
Model answer
Prerogative powers are defined by common law and convention rather than by an authoritative text, so their limits are established case by case. Irish executive power is written down, and a court can measure a Government action directly against the wording.
- 4
Compare the two executives' control of the legislative agenda.
Model answer
Both dominate the legislative programme, and in both almost all successful legislation is government legislation. Both can curtail debate, the Irish Government by guillotine and the United Kingdom Government by programme motion.
- 5
Compare the power to make secondary legislation.
Model answer
Ministers in both systems make large volumes of detailed law under powers delegated by the legislature. Irish delegation is limited by the constitutional requirement that the parent Act state the principles and policies, while Westminster's only real limit is the terms of the enabling Act itself.
- 6
Compare the two executives' powers over the armed forces.
Model answer
The Irish Constitution forbids participation in war without the assent of Dáil Éireann, and Irish policy of military neutrality restricts deployment further. United Kingdom deployment rests on prerogative, with a convention since 2003 that the Commons is consulted, as when it voted against strikes on Syria in 2013.
