Questions from this subtopic
Each one with the model answer underneath.
- 1
What did the Human Rights Act 1998 do?
Model answer
The Human Rights Act 1998 gave effect in United Kingdom law to most of the rights in the European Convention on Human Rights, so that they can be argued in domestic courts rather than only in Strasbourg. The Act came into force in October 2000.
- 2
Why is it inaccurate to describe the European Convention on Human Rights as an institution of the European Union?
Model answer
The Convention is a treaty of the Council of Europe and is enforced by the European Court of Human Rights in Strasbourg, an entirely separate body from the European Union and its courts.
- 3
What duty does the Human Rights Act place on public authorities?
Model answer
The Act makes it unlawful for a public authority, including a minister, a department, the police and a local council, to act in a way incompatible with Convention rights unless an Act of Parliament requires it.
- 4
How must the courts interpret legislation under the Human Rights Act?
Model answer
The courts must read and give effect to legislation compatibly with Convention rights so far as it is possible to do so, which allows a strained reading to be preferred to an incompatible one.
- 5
What is a declaration of incompatibility?
Model answer
A declaration of incompatibility is a formal statement by a senior court that a provision of an Act of Parliament cannot be read compatibly with Convention rights.
- 6
What is the legal effect of a declaration of incompatibility?
Model answer
A declaration of incompatibility does not invalidate the provision or affect the case's outcome under it. The declaration leaves the decision on whether to change the law entirely to Parliament and ministers.
