Questions from this topic
Each one with the model answer underneath.
- 1
What is Bunreacht na hÉireann?
Model answer
Bunreacht na hÉireann is the Constitution of Ireland, adopted by the people in a referendum in 1937. Every other law in the State takes its authority from it.
- 2
Name the three elements that together make up the Oireachtas.
Model answer
The Oireachtas consists of the President, Dáil Éireann and Seanad Éireann.
- 3
Which body does the Constitution give the power to make law for the State?
Model answer
The Constitution vests the sole and exclusive power of making laws for the State in the Oireachtas.
- 4
What limit does the Constitution place on the laws the Oireachtas may pass?
Model answer
The Oireachtas may not enact any law that is repugnant to the Constitution, and a law that is repugnant is invalid to that extent.
- 5
In what sense are the people, rather than the Oireachtas, sovereign in Ireland?
Model answer
The Constitution states that all powers of government derive from the people, and only the people can amend the Constitution by referendum. The Oireachtas is therefore a creature of the Constitution rather than master of it.
- 6
Explain the difference between parliamentary sovereignty and constitutional supremacy.
Model answer
Under parliamentary sovereignty a legislature can make or unmake any law and no court may set it aside. Under constitutional supremacy the constitution is the higher law and the courts can strike down legislation that conflicts with it, as in Ireland.
