Questions from this subtopic
Each one with the model answer underneath.
- 1
How is Bunreacht na hÉireann formally amended?
Model answer
An amendment must be initiated as a bill in Dáil Éireann, passed by both Houses of the Oireachtas, and then approved by the people in a referendum.
- 2
What majority is needed to carry a referendum on a constitutional amendment?
Model answer
A proposal is carried if a majority of the votes cast are in favour. There is no minimum turnout and no special majority.
- 3
Can the President refer a constitutional amendment bill to the Supreme Court?
Model answer
A bill to amend the Constitution cannot be referred under Article 26, because the people themselves are the authority on the text of the Constitution.
- 4
Why does formal amendment matter so much to the study of the Irish executive?
Model answer
The Government's powers are defined in the Constitution, so any lasting change to them has to be approved by the electorate. A Government can lose a referendum and be unable to proceed, which has no equivalent in a system based on parliamentary sovereignty.
- 5
Which amendment allowed Ireland to join the European Communities?
Model answer
An amendment approved by referendum in 1972 permitted membership of the European Communities, and it was carried by about 83% of those voting.
- 6
Why was an amendment needed in 1987?
Model answer
The Supreme Court had held that the Government could not ratify the foreign policy provisions of the Single European Act without constitutional change, so an amendment was put to the people and approved. Ratification followed.
