Questions from this subtopic
Each one with the model answer underneath.
- 1
How does the Disability Discrimination Act 1995 define disability?
Model answer
The Disability Discrimination Act 1995 defines disability as a physical or mental impairment with a substantial and long-term adverse effect. The effect must be on a person's ability to carry out normal day-to-day activities.
- 2
How long must an impairment last to count as long-term under the Disability Discrimination Act 1995?
Model answer
An impairment counts as long-term where it has lasted, or is likely to last, at least twelve months. An impairment likely to last for the rest of a person's life also counts.
- 3
Why is the Disability Discrimination Act 1995 still the operative law in Northern Ireland?
Model answer
The Equality Act 2010 was never extended to Northern Ireland, so the Disability Discrimination Act 1995, amended by the Disability Discrimination (Northern Ireland) Order 2006, continues to apply there.
- 4
What is the duty to make reasonable adjustments?
Model answer
The duty to make reasonable adjustments obliges an employer or service provider to change a practice, remove a physical obstacle or supply an aid so that a disabled person is not placed at a substantial disadvantage.
- 5
Give three reasonable adjustments a day centre could make for people with disabilities.
Model answer
A day centre could install a ramp and accessible toilet, produce its newsletter in large print and audio, and allow a support worker to attend with a person who needs one.
- 6
What makes an adjustment reasonable rather than required in every case?
Model answer
Whether an adjustment is reasonable depends on how effective it would be, how practical it is, what it costs and what resources the organisation has, so a small nursery and a large trust may be expected to do different things.
