What does the Children (Northern Ireland) Order 1995 establish?

The Order is the main law on the care and protection of children in Northern Ireland. It makes the child's welfare the paramount consideration, introduces parental responsibility, and places a duty on Trusts to safeguard and promote the welfare of children in need.
- 2
What is meant by the paramountcy principle?
Model answer
The paramountcy principle is the rule that when a court decides any question about a child's upbringing, the child's welfare is the first and overriding consideration, above the wishes of parents or the convenience of services.

What is a child in need under the Children (Northern Ireland) Order 1995?
Model answer
A child in need is one who is unlikely to achieve or maintain a reasonable standard of health or development without services from a Trust, whose health or development would be significantly impaired without them, or who has a disability.

What does the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007 do?
Model answer
The Order created the system for barring unsuitable people from working with children or vulnerable adults and requires those working in regulated activity to be checked. It was amended by the Protection of Freedoms Act 2012, which narrowed the definition of regulated activity.
- 5
What is a pre-employment check in a care setting, and why is it required?
Model answer
Before a person begins work with children or vulnerable adults their criminal record and barred list status are checked through AccessNI, because employing somebody who has been barred would place service users at risk and is an offence.

What does the Mental Health (Northern Ireland) Order 1986 provide for?
Model answer
The Order sets out when a person may be assessed, detained and treated for a mental disorder without their consent, the safeguards that apply, and the role of the Mental Health Review Tribunal in reviewing detention. It was amended in 2004.
