- 3 things to know
- AS Unit 1
Overview
Terms data subject, data controller and data processor, special category data and five rights the law gives a data subject.
What you need to know
Answer each one before you reveal it.
State the data protection principles that personal data must be processed in accordance with.
Name five rights the law gives a data subject.
Questions from this subtopic
Each one with the model answer underneath.
- 1
Which law governs the use of personal data in the United Kingdom?
Model answer
The Data Protection Act 2018, which works alongside the United Kingdom General Data Protection Regulation.
- 2
Which earlier statute did the Data Protection Act 2018 replace?
Model answer
It replaced the Data Protection Act 1998, which is no longer the law.
- 3
Define the terms data subject, data controller and data processor.
Model answer
The data subject is the living person the data is about, the controller is the organisation that decides why and how the data is processed, and the processor is anyone who processes it on the controller's behalf.
- 4
State the data protection principles that personal data must be processed in accordance with.
Model answer
It must be processed lawfully, fairly and transparently, collected for specified purposes, limited to what is necessary, accurate and kept up to date, kept no longer than needed, and held securely, with the controller accountable for demonstrating all of this.
- 5
What is special category data, and give three examples.
Model answer
It is data needing extra protection because misuse would be especially harmful, including data about health, racial or ethnic origin, and religious or political beliefs.
- 6
What must be true of consent for it to be a valid basis for processing?
Model answer
It must be freely given, specific, informed and unambiguous, indicated by a clear affirmative action, and the person must be able to withdraw it as easily as they gave it.
