How the legislation affects employees and the public
- 3 things to know
- A2 Unit 1
Overview
Acceptable use policy and expected of an employee who handles personal data.
What you need to know
Answer each one before you reveal it.
What rights does an employee have over the personnel data their employer holds?
How does the accuracy principle help a member of the public in practice?
Questions from this subtopic
Each one with the model answer underneath.
- 1
What is an acceptable use policy, and why does it matter legally?
Model answer
An acceptable use policy sets out what employees may and may not do with the organisation's systems. The policy defines the boundary of each person's authority, so going beyond it is plainly unauthorised.
- 2
What is expected of an employee who handles personal data?
Model answer
An employee handling personal data must use it only for the task their job requires. Personal data must not be disclosed to anyone not entitled to see it. The organisation's procedures for storing and sending it must also be followed.
- 3
Why is looking up a neighbour's record out of curiosity a serious matter?
Model answer
An employee who looks up a record with no business reason breaches both the policy and the law. The employee's authority never extended to that data, so the access is unauthorised.
- 4
What rights does an employee have over the personnel data their employer holds?
Model answer
An employee is a data subject in relation to their own personnel file. The employee may ask for a copy of it and have inaccurate entries corrected. An employer must also say why the information is kept.
- 5
Who owns the program code an employee writes at work?
Model answer
Code written by an employee in the course of their employment belongs to the employer, and the same applies to documents, designs and other material produced as part of the job.
- 6
What is the consequence of an employee installing unlicensed software on a work computer?
Model answer
Software installed without a licence infringes copyright and exposes the employer to a claim for damages. Employers restrict the right to install software to administrators for precisely this reason.
