Questions from this topic
Each one with the model answer underneath.
- 1
What does discharge of a contract mean?
Model answer
Discharge means that the parties are released from their obligations under the contract. Discharge may occur by performance, agreement, breach or frustration.
- 2
State the general rule on discharge by performance.
Model answer
Performance must be complete and exact before the obligation is discharged. A party who falls short of full performance cannot claim the contract price.
- 3
What is an entire obligation?
Model answer
An entire obligation is one that must be performed in full before payment falls due. Part performance of an entire obligation earns nothing under the contract.
- 4
State the rule in Cutter v Powell (1795).
Model answer
Cutter v Powell (1795) held that a seaman who died before completing the voyage earned no wages. The lump sum was payable only on complete performance of the whole voyage.
- 5
Why was the result in Cutter v Powell (1795) so harsh?
Model answer
The widow recovered nothing although her husband had served most of the voyage. The agreed lump sum was well above the ordinary rate, which the court treated as reflecting the risk.
- 6
How does the entire obligations rule protect the paying party?
Model answer
The paying party is not obliged to accept and pay for incomplete work. The rule gives the other side a strong incentive to finish the job.
