Questions from this subtopic
Each one with the model answer underneath.
- 1
Why does precedent depend on law reporting?
Model answer
A precedent can only be followed if lawyers and judges can read exactly what was decided and why. Accurate published reports are therefore essential to the whole doctrine.
- 2
Which body was founded in 1865 to improve law reporting?
Model answer
The Incorporated Council of Law Reporting for England and Wales was founded in 1865. The Council publishes the official series known as The Law Reports.
- 3
Name two other series of law reports.
Model answer
The Weekly Law Reports and the All England Law Reports are two widely used series. Specialist series also cover fields such as criminal appeals and family law.
- 4
What is a neutral citation?
Model answer
A neutral citation identifies a judgment by court and number rather than by the series in which it is printed. Neutral citations were introduced in 2001 alongside numbered paragraphs.
- 5
How has access to judgments improved?
Model answer
Judgments are now published free online almost as soon as they are handed down. Free access allows a litigant without a lawyer to read the authority for themselves.
- 6
Do judges make law?
Model answer
Judges make law whenever they create an original precedent or overrule an earlier decision. Lord Reid accepted openly that the declaratory theory no longer describes what judges do.
