Questions from this topic
Each one with the model answer underneath.
- 1
Define vicarious liability.
Model answer
Vicarious liability makes one person liable for a tort committed by another. Liability arises from the relationship between them rather than from any fault of the person held liable.
- 2
What three things must a claimant prove to establish vicarious liability?
Model answer
The claimant must prove that a tort was actually committed. The claimant must prove a relationship of employment or one akin to employment. The tort must also have been committed in the course of that relationship.
- 3
Is vicarious liability a tort in itself?
Model answer
Vicarious liability is not a separate tort but a rule attributing liability for another person's wrong. The underlying tort must still be proved against the person who committed it.
- 4
Does the employee escape liability where the employer is vicariously liable?
Model answer
The employee remains personally liable for the tort committed. A claimant may sue the employer, the employee, or both as joint tortfeasors.
- 5
Why do claimants usually sue the employer rather than the employee?
Model answer
An employer carries insurance and has the resources to meet a substantial award. An individual employee often has neither money nor cover.
- 6
Is vicarious liability a form of strict liability?
Model answer
The employer is liable without any fault of its own, so the liability is strict. The claimant must still prove the tort against the employee who committed it.
