Questions from this subtopic
Each one with the model answer underneath.
- 1
What does the Equality Act 2010 do?
Model answer
The Equality Act 2010 consolidated earlier discrimination legislation into a single statute. The Act prohibits discrimination in employment, services, education and public functions.
- 2
What are the protected characteristics under the Equality Act 2010?
Model answer
The Act lists nine protected characteristics. Age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, and sexual orientation are the nine.
- 3
How does the Equality Act complement Convention rights?
Model answer
Convention rights operate mainly against the state, while the Equality Act regulates employers and service providers as well. The Act therefore reaches private conduct that Article 14 alone would not.
- 4
What is the public sector equality duty?
Model answer
The public sector equality duty requires a public authority to have due regard to eliminating discrimination, advancing equality of opportunity and fostering good relations. The duty applies when exercising functions rather than only when a complaint is made.
- 5
What role do parliamentary committees play in protecting rights?
Model answer
A joint committee of both Houses examines Bills for compatibility with human rights and reports on wider issues. Scrutiny before enactment is intended to prevent incompatibility rather than to litigate it afterwards.
- 6
What is the role of the ombudsman services?
Model answer
Ombudsman services investigate maladministration by public bodies and recommend redress. The route is free to the complainant and reaches poor administration that would not amount to unlawfulness.
