Each one with the model answer underneath.

  1. 1

What does the rule of law require of a government in its treatment of citizens?

    Model answer

The rule of law requires government to act only under a legal power and to treat like cases alike. Officials under the rule of law are subject to the same courts as everyone else.

  2. 2

Which nineteenth-century writer set out three elements of the rule of law?

    Model answer

    A. V. Dicey set out the rule of law in three limbs in 1885. Dicey required the absence of arbitrary power, equality before the law, and rights grounded in ordinary court decisions.

  3. 3

Which judge argued that the rule of law includes adequate protection of fundamental human rights?

    Model answer

Lord Bingham included the protection of fundamental human rights among his principles of the rule of law. Bingham set out those principles in his book The Rule of Law, published in 2010.

  4. 4

Explain the link between the rule of law and the ban on retrospective criminal liability.

    Model answer

The rule of law requires a citizen to know in advance what conduct is forbidden. A retrospective offence punishes behaviour that was lawful when it was carried out.

  5. 5

    What is distributive justice?

    Model answer

Distributive justice concerns the fair allocation of benefits and burdens across a society. Arguments about welfare provision and access to health care are distributive arguments.

  6. 6

    What is corrective justice?

    Model answer

Corrective justice concerns putting right a wrong done by one party to another. An award of damages against a public authority is an exercise in corrective justice.
