Whose theory is corrective justice traditionally traced to?
How does the compensatory measure of damages express corrective justice?
Questions from this subtopic
Each one with the model answer underneath.
- 1
What does corrective justice require of the law of tort?
Model answer
Corrective justice requires the wrongdoer to put right the loss wrongly inflicted on the victim. The payment runs from the party who caused the harm to the party who suffered it.
- 2
Whose theory is corrective justice traditionally traced to?
Model answer
Corrective justice is traditionally traced to Aristotle's distinction between corrective and distributive justice. Corrective justice restores the balance disturbed by a wrong between two parties.
- 3
How does the compensatory measure of damages express corrective justice?
Model answer
Damages in tort aim to put the claimant into the position occupied before the tort was committed. The measure looks at the claimant's loss and not at any gain to the defendant.
- 4
What is distributive justice, and how does it differ from corrective justice in tort?
Model answer
Distributive justice shares burdens and benefits across society according to need or desert. Corrective justice looks only at the two parties to the particular wrong.
- 5
Give two criticisms of corrective justice as an explanation of modern tort law.
Model answer
Liability insurance means the loss is borne by an insurer rather than by the wrongdoer. Vicarious liability is also hard to explain, because a blameless employer pays for another's wrong.
- 6
How does corrective justice explain the requirement of causation?
Model answer
Corrective justice ties the defendant to the particular loss the defendant brought about. A defendant who did not cause the damage has no imbalance to correct.
