Questions from this subtopic

Each one with the model answer underneath.

  1. 1

    What is track allocation?

    Model answer

Track allocation is the process by which a court assigns a defended claim to a procedural track. Allocation decides how much preparation, evidence and cost the case will attract.

  2. 2

How does a court gather the information it needs to allocate a claim?

    Model answer

The court sends each party a directions questionnaire once a defence is filed. Answers about value, witnesses, experts and trial length guide the allocation decision.

  3. 3

Name the four tracks in use since October 2023.

    Model answer

The small claims track, the fast track, the intermediate track and the multi-track are the four tracks. The intermediate track was introduced on 1 October 2023.

  4. 4

What is the normal value limit for the small claims track?

    Model answer

The small claims track normally takes claims worth up to £10,000. The £10,000 limit has applied since April 2013, when it rose from £5,000.

  5. 5

What is the small claims limit for a personal injury claim?

    Model answer

A personal injury claim goes to the small claims track only where damages for the injury are £1,000 or less. Road traffic whiplash claims have had a £5,000 limit since 31 May 2021.

  6. 6

Why is the small claims track described as informal?

    Model answer

A district judge hears a small claim without the strict rules of evidence used at trial. Costs recovery is very limited, so most parties appear without a lawyer.
