- 1
What is a licence in the law of trespass to land?
Model answer
A licence is permission from the occupier to be on the land. A person acting within a licence commits no trespass.
- 2
How is a licence to enter land revoked?
Model answer
An occupier may revoke a licence at any time by asking the person to leave. The person must have a reasonable time to go before becoming a trespasser.

Model answer
A person exercising a right of entry conferred by law commits no trespass. Police officers, bailiffs and utility inspectors may all hold such rights.
- 4
Give an example of a statutory power of entry held by the police.
Model answer
Section 17 of the Police and Criminal Evidence Act 1984 allows entry to arrest for an indictable offence or to save life. Section 18 allows a search of premises after an arrest.
- 5
What is trespass ab initio?
Model answer
Trespass ab initio treats an entry made under legal authority as unlawful from the start where the entrant abuses that authority. The doctrine comes from the Six Carpenters' Case (1610) and is rarely used today.
- 6
Can necessity justify entry onto another person's land?
Model answer
Necessity may justify entry to prevent a greater harm, such as putting out a fire. The defence is narrow and the danger must be real and immediate.
