Model answer
Alternative dispute resolution covers ways of settling a civil dispute without a court trial. Negotiation, mediation, conciliation and arbitration are the main forms.
- 2
What is negotiation?
Model answer
Negotiation is direct discussion between the parties or their solicitors aimed at settlement. Negotiation is the cheapest and most private form of dispute resolution.
- 3

Model answer
Mediation is a process in which a neutral third party helps the parties reach their own agreement. A mediator carries offers between the parties but does not impose a solution.
- 4
How does a typical mediation work?
Model answer
The mediator meets the parties together and then separately in private caucuses. Offers are carried between the rooms until the parties reach terms or the mediation ends.
- 5
Is a mediated settlement binding?
Model answer
A mediated settlement becomes binding once the parties record it in a written agreement. The written agreement is enforceable as a contract or by consent order.
- 6
Define conciliation.
Model answer
Conciliation is a process in which a neutral third party takes an active part in suggesting a settlement. A conciliator may offer a view on the merits of the dispute.
