Each one with the model answer underneath.
- 1
What must a restriction on expression satisfy under Article 10(2)?
Model answer
A restriction must be prescribed by law and pursue one of the aims listed in Article 10(2). The restriction must also be necessary in a democratic society and proportionate.
- 2
Which aims in Article 10(2) concern the state and public order?
Model answer
Article 10(2) allows restrictions for national security, territorial integrity and public safety. Restrictions are also permitted for the prevention of disorder or crime.
- 3
Which aims in Article 10(2) protect other people and the courts?
Model answer
Article 10(2) permits restrictions protecting health or morals and the reputation or rights of others. Restrictions may also prevent disclosure of information received in confidence, or maintain the authority of the judiciary.
- 4
Why is Article 10 said to carry the longest list of exceptions in the Convention?
Model answer
Article 10(2) contains more permitted aims than any other qualified Article. The breadth of that list reflects how easily expression can damage other interests.
- 5
How precise must a restriction on expression be?
Model answer
A restriction must be set out in a rule that the citizen can find and understand. The rule must let a person foresee to a reasonable degree what expression will attract a penalty.
- 6
Which case protected a broadcaster who had interviewed racist speakers?
Model answer
Jersild v Denmark (1994) held that convicting a journalist for broadcasting an interview with racist youths breached Article 10. The programme reported on a social problem rather than promoting the views expressed.
