Judicial Precedent
Advantages and disadvantages of precedent
- 3 things to know
- Component 1
Overview
Certainty, consistency, precision and time saved, set against rigidity, volume, illogical distinctions, slowness and retrospective effect — and how the doctrine compares with legislation as a way of changing the law.
What you need to know
Answer each one before you reveal it.
How does precedent create certainty?
How does precedent create consistency and fairness?
Questions from this subtopic
Each one with the model answer underneath.
- 1
How does precedent create certainty?
Model answer
Precedent lets a lawyer predict the outcome of a dispute by reading the decided cases. Certainty of that kind allows most disputes to be settled without a trial.
- 2
How does precedent create consistency and fairness?
Model answer
Precedent requires similar cases to be decided in the same way. A litigant is therefore treated no worse than an earlier litigant in the same position.
- 3
Why is precedent said to produce precise rules?
Model answer
Each precedent arises from a real dispute with concrete facts. The resulting rule is worked out against practical problems rather than drafted in the abstract.
- 4
How is precedent flexible despite being binding?
Model answer
The Supreme Court can depart under the Practice Statement and any judge can distinguish on the facts. The Court of Appeal can also use the exceptions in Young v Bristol Aeroplane.
- 5
How does precedent save time?
Model answer
A settled point does not have to be argued again from first principles in every case. Court time is then spent only on genuinely new questions.
- 6
Why is rigidity a criticism of precedent?
Model answer
A court bound by a bad decision must apply it until a higher court intervenes. The Court of Appeal in particular is tied by its own past rulings.
