The Criminal Process
Justice, interests and barriers in the criminal process
- 3 things to know
- Component 1
Overview
Who the parties to a criminal case are and what each of them wants from it, where public interest and private interest pull apart, and how delay and miscarriages of justice damage confidence in the whole process.
What you need to know
Answer each one before you reveal it.
Who are the parties to a criminal case and what interests do they hold?
How does the identification of different interests help in evaluating criminal justice?
Questions from this subtopic
Each one with the model answer underneath.
- 1
How does the criminal process balance conflicting interests?
Model answer
The criminal process must protect the public from crime while protecting a defendant from wrongful conviction. The balancing of those conflicting interests runs through bail, disclosure and sentencing.
- 2
Who are the parties to a criminal case and what interests do they hold?
Model answer
The parties are the prosecution acting for the state and the defendant answering the charge. The prosecution seeks conviction of the guilty while the defendant seeks liberty and a fair hearing.
- 3
How does the identification of different interests help in evaluating criminal justice?
Model answer
Identification of the interests held by victims, defendants, witnesses and the public shows why a reform helps one group. A rule that favours one interest will usually weaken another.
- 4
How can public interests conflict with private interests in a criminal trial?
Model answer
The public interest in open justice can conflict with a witness's private interest in anonymity. Restrictions on reporting and special measures try to reconcile the two.
- 5
What is the public interest in prosecuting an offence?
Model answer
The public interest lies in deterring crime, protecting victims and upholding confidence in the law. A prosecution is brought in the name of the state rather than of the victim.
- 6
How can criminal procedure create barriers to justice?
Model answer
Delay, court closures and the cost of private representation are all barriers to justice. A defendant who cannot reach court or afford advice is disadvantaged before any trial begins.
