Questions from this subtopic
Each one with the model answer underneath.
- 1
What is the defence of prescription in private nuisance?
Model answer
Prescription gives a right to continue a nuisance carried on for twenty years. The twenty years run from the time the activity first became a nuisance to that claimant.
- 2
What did Sturges v Bridgman (1879) decide about prescription?
Model answer
A confectioner had used noisy machinery for more than twenty years before a doctor built a consulting room next door. The court rejected the defence, because the noise became a nuisance only when the consulting room was built.
- 3
What is the defence of statutory authority?
Model answer
Statutory authority protects a defendant whose activity is authorised by an Act of Parliament. The nuisance must be an inevitable consequence of doing what the statute permits.
- 4
What did Allen v Gulf Oil Refining Ltd [1981] decide?
Model answer
A private Act of Parliament authorised the construction and operation of an oil refinery. The House of Lords held the smell, noise and vibration to be an inevitable result of the authorised activity, so the defence succeeded.
- 5
Is planning permission a defence to a claim in nuisance?
Model answer
Planning permission is not statutory authority and cannot authorise a nuisance. Wheeler v JJ Saunders Ltd [1996] confirmed that a planning consent gives no licence to wrong a neighbour.
- 6
How does planning permission still matter after Coventry v Lawrence [2014]?
Model answer
Planning permission may be evidence of the character of the locality against which reasonableness is judged. The Supreme Court held in 2014 that permission neither authorises a nuisance nor is wholly irrelevant.
