Questions from this subtopic
Each one with the model answer underneath.
- 1
What is a declaration of incompatibility?
Model answer
A declaration of incompatibility is a formal statement by a higher court. The court states that a statutory provision cannot be read compatibly with a Convention right. The declaration records the conflict without resolving it.
- 2
Which courts may make a declaration of incompatibility?
Model answer
Only the higher courts may make a declaration. The High Court, the Court of Appeal, the Supreme Court and certain other senior courts are listed in the Act.
- 3
What is the legal effect of a declaration of incompatibility?
Model answer
A declaration does not affect the validity, continuing operation or enforcement of the provision. The provision remains law and the parties to the case are not bound differently as a result.
- 4
Why does a declaration bind nobody?
Model answer
The Act was designed to preserve parliamentary sovereignty. Striking down an Act of Parliament would transfer final authority from Parliament to the courts, which the Act deliberately avoids.
- 5
What happens after a declaration is made?
Model answer
The government must decide how to respond to a declaration. Parliament may legislate in the ordinary way, or a minister may make a remedial order. The government may also do nothing at all.
- 6
What is a remedial order?
Model answer
A remedial order is a ministerial order amending legislation to remove an incompatibility. The order may be made where there are compelling reasons, and it is subject to parliamentary procedure.
