Questions from this subtopic
Each one with the model answer underneath.
- 1
When is an injunction sought in a claim in tort?
Model answer
An injunction is sought where a tort is continuing or is likely to be repeated. A court orders the defendant to stop the wrong, or occasionally to undo it.
- 2
What is a prohibitory injunction?
Model answer
A prohibitory injunction orders the defendant to stop the wrongful conduct. Most injunctions granted in tort are prohibitory.
- 3
What is a mandatory injunction?
Model answer
A mandatory injunction orders the defendant to take positive action, such as pulling down a wall. Courts grant mandatory injunctions sparingly because of the expense involved.
- 4
What is an interim injunction?
Model answer
An interim injunction holds the position between the parties until trial. The order is temporary and may be discharged when the case is finally decided.
- 5
What test applies to an application for an interim injunction?
Model answer
American Cyanamid Co v Ethicon Ltd [1975] asks first whether there is a serious question to be tried. The court then asks whether damages would be an adequate remedy. The court finally weighs where the balance of convenience lies.
- 6
What is a suspended injunction?
Model answer
A suspended injunction takes effect only after a stated period has passed. The delay gives the defendant time to bring the wrong to an end.
