Questions from this subtopic
Each one with the model answer underneath.
- 1
Give the classic definition of murder.
Model answer
Murder is the unlawful killing of a reasonable person in being under the King's Peace. The killing must be committed with malice aforethought.
- 2
Is murder a statutory or a common law offence?
Model answer
Murder remains a common law offence with no statutory definition. Statute has altered the sentence and the partial defences but not the definition.
- 3
What is meant by a reasonable person in being?
Model answer
A reasonable person in being is a human being who has been born alive and has an existence independent of the mother. A foetus is therefore not a victim of murder.
- 4
Which case decided that a foetus is not a person in being for murder?
Model answer
Attorney-General's Reference (No 3 of 1994) [1997] held that a foetus is not a person in being. A child born alive who then dies from prenatal injuries can found manslaughter.
- 5
What does the phrase under the King's Peace exclude?
Model answer
The requirement excludes the killing of an enemy combatant in the course of war. All other killings within the jurisdiction fall within the phrase.
- 6
What was the year and a day rule, and does it still apply?
Model answer
The old rule required death to follow within a year and a day of the injury. The Law Reform (Year and a Day Rule) Act 1996 abolished that limit.
