Questions from this subtopic
Each one with the model answer underneath.
- 1
What does Article 11(1) protect?
Model answer
Article 11(1) protects freedom of peaceful assembly and freedom of association with others. Article 11(1) expressly includes the right to form and to join trade unions to protect one's interests.
- 2
What makes an assembly peaceful for the purposes of Article 11?
Model answer
An assembly is peaceful where the organisers and participants hold no violent intentions. An assembly does not lose protection merely because it annoys or inconveniences other people.
- 3
Does Article 11 protect a static protest as well as a march?
Model answer
Article 11 covers static demonstrations, meetings and processions alike. Both public and private gatherings fall within the protection.
- 4
What positive obligation arises under Article 11?
Model answer
The state must take reasonable steps to allow a lawful assembly to go ahead, including policing it. The threat of a hostile counter-demonstration does not by itself justify a ban.
- 5
What restrictions does Article 11(2) permit?
Model answer
Article 11(2) permits restrictions prescribed by law and necessary in a democratic society. The permitted aims are national security, public safety and the prevention of disorder or crime. Protection of health, morals and the rights of others completes the list.
- 6
Which groups may have their Article 11 rights restricted in a special way?
Model answer
Article 11(2) allows lawful restrictions on members of the armed forces, the police and the administration of the State. The restrictions still need a basis in law and must not destroy the essence of the right.
