Is membership of the Convention the same as membership of the European Union?
Questions from this subtopic
Each one with the model answer underneath.
- 1
Is membership of the Convention the same as membership of the European Union?
Model answer
The two are entirely separate. The Convention belongs to the Council of Europe, and leaving the European Union did not affect the United Kingdom's Convention obligations.
- 2
What would withdrawal from the Convention involve?
Model answer
Withdrawal would require formal denunciation under the Convention's own provisions, taking effect after a notice period. The United Kingdom would leave the jurisdiction of the Strasbourg court.
- 3
What is the argument for withdrawal?
Model answer
Supporters argue that a foreign court should not have the last word on questions for the United Kingdom's own institutions. Withdrawal is presented as restoring final authority to Parliament and the domestic courts.
- 4
What is the argument against withdrawal?
Model answer
Critics argue that withdrawal would place the United Kingdom alongside the very few European states outside the system. The Belfast Agreement, the devolution settlements and several international agreements would all be affected.
- 5
Which European states are outside the Convention system?
Model answer
Membership of the Council of Europe covers almost all of Europe. Belarus has never joined, and Russia ceased to be a party following its expulsion from the Council of Europe in 2022.
- 6
How does the Convention interact with the devolution settlements?
Model answer
The devolved legislatures cannot legislate incompatibly with Convention rights, and devolved ministers cannot act incompatibly. Convention rights therefore operate as a limit on devolved competence.
