- 3 things to know
- Components 2 and 3
Overview

What you need to know
Answer each one before you reveal it.
What did Montgomery v Lanarkshire Health Board [2015] decide about advising a patient?
How did Bolitho v City and Hackney Health Authority [1998] qualify the Bolam test?
Questions from this subtopic
Each one with the model answer underneath.
- 1
State the Bolam test.
Model answer
Bolam v Friern Hospital Management Committee [1957] set the test for professional negligence. A professional is not negligent when acting in line with a practice accepted by a responsible body of opinion. Disagreement between experts does not by itself prove negligence.
- 2
How did Bolitho v City and Hackney Health Authority [1998] qualify the Bolam test?
Model answer
Bolitho v City and Hackney Health Authority [1998] held that the supporting body of opinion must withstand logical analysis. A practice that cannot be defended logically will not protect the defendant.
- 3
What standard applies to a trainee professional?
Model answer
A trainee is judged by the standard of the post held rather than by personal experience. A junior doctor must reach the standard of a reasonably competent doctor in that post.
- 4
What did Montgomery v Lanarkshire Health Board [2015] decide about advising a patient?
Model answer
Montgomery v Lanarkshire Health Board [2015] concerned a failure to warn a diabetic mother about the risk of shoulder dystocia. A doctor must disclose any material risk a reasonable patient would think significant. The doctor must also disclose a risk this particular patient would think important.
- 5
Why is Montgomery said to have moved away from Bolam?
Model answer
Montgomery replaced the profession's own view of what to disclose with the patient's right to decide. The reasonable patient now sets the content of the duty to advise about risks.
- 6
Must a person who claims a special skill reach the standard of that skill?
Model answer
A person holding themselves out as having a special skill must reach the standard of a reasonably competent practitioner of it. An unqualified person doing skilled work is judged by the same standard.
