Each one with the model answer underneath.
- 1
Why is a person generally not liable for an independent contractor's tort?
Model answer
An independent contractor runs a separate business and carries its own risks. The person engaging the contractor does not control how the work is done.
- 2
How is an independent contractor distinguished from an employee?
Model answer
An independent contractor works under a contract for services rather than a contract of service. The contractor supplies equipment, takes the financial risk and usually serves several clients.
- 3
When is a person engaging a contractor liable in their own right?
Model answer
Liability arises for negligence in choosing an incompetent contractor. Liability also arises for failing to supervise where supervision was needed.
- 4
How does the choice of contractor create liability for an unusually hazardous activity?
Model answer
A person who engages an incompetent contractor for a dangerous activity is liable for negligence in that choice. A cricket club hired an uninsured and unqualified stunt team for a firework display. The club was held liable in 2003 for choosing them.
- 5
What is a non-delegable duty?
Model answer
A non-delegable duty is a duty to see that care is taken, rather than a duty merely to take care personally. Engaging a competent contractor does not discharge such a duty.
- 6
What did Woodland v Swimming Teachers Association [2013] decide?
Model answer
A pupil was injured during a swimming lesson taught by an independent contractor engaged by her school. The Supreme Court held that the school owed a non-delegable duty to its pupils.
