Questions from this subtopic
Each one with the model answer underneath.
- 1
On what basis may premises be searched with a warrant?
Model answer
A justice of the peace may issue a warrant on reasonable grounds for believing an indictable offence has been committed. Material of substantial value to the investigation must be on the premises. The warrant specifies the premises and, so far as practicable, the articles sought.
- 2
When may premises be searched without a warrant?
Model answer
Premises occupied or controlled by a person under arrest for an indictable offence may be searched. Premises where a person was when arrested, or immediately before, may also be searched for evidence of that offence.
- 3
What material is protected from seizure?
Model answer
Items subject to legal privilege may not be seized. Excluded material and special procedure material, such as journalistic material and confidential records, are subject to a separate application to a circuit judge.
- 4
What safeguards apply to the execution of a search warrant?
Model answer
A warrant must ordinarily be executed within three months and at a reasonable hour. The occupier is entitled to see the warrant and to be given a copy, and a record of the search must be made.
- 5
What are the general police powers relating to terrorism?
Model answer
Terrorism legislation provides powers of arrest without a specified offence, extended pre-charge detention, and search powers exercisable in an authorised area. Proscription of organisations and offences of membership and support sit alongside them.
- 6
Why were the earlier suspicionless terrorism stop powers replaced?
Model answer
The earlier power was held incompatible with Article 8 because it was too broadly drawn and inadequately supervised. The replacement power was narrowed and made subject to tighter authorisation conditions.
