- 1
How does the Human Rights Act 1998 reach into the law of contract?
Model answer
The Human Rights Act 1998 requires courts to read legislation compatibly with Convention rights so far as possible. Courts are public authorities, so Convention rights influence how contractual disputes are decided.
- 2
Which Convention right protects a contractual entitlement as a possession?
Model answer
Article 1 of Protocol 1 protects the peaceful enjoyment of possessions. Contractual rights of economic value can count as possessions under that Article.
- 3
What was in issue in Wilson v First County Trust Ltd (No 2) [2003]?
Model answer
Wilson v First County Trust Ltd (No 2) [2003] concerned a consumer credit agreement made unenforceable by a statutory defect. The House of Lords held that the Human Rights Act 1998 had no retrospective effect. The agreement predated the Act, so Convention rights did not assist the borrower.
- 4
How can Article 8 affect a contract about a person's home?
Model answer
Article 8 protects respect for private and family life and the home. A possession claim against an occupier may require the court to consider proportionality.
- 5
How can Article 6 be relevant to contractual disputes?
Model answer
Article 6 guarantees a fair hearing in the determination of civil rights and obligations. A contract term ousting access to the courts may therefore be scrutinised.
- 6
Explain how Article 11 can conflict with a contract of employment.
Model answer
Article 11 protects freedom of assembly and association, including trade union membership. An employment term penalising union membership may be challenged on that basis.
