Questions from this subtopic
Each one with the model answer underneath.
- 1
Define a by-law.
Model answer
A by-law is delegated legislation made by a local authority or a public corporation for its own area or premises. A by-law binds only within that limited territory.
- 2
Which Act gives local authorities their general power to make by-laws?
Model answer
The Local Government Act 1972 gives district and county councils a general power to make by-laws. The by-laws must be for the good rule and government of the area.
- 3
Do local authority by-laws need approval?
Model answer
Many local authority by-laws must be confirmed by the relevant Secretary of State before taking effect. Confirmation gives central government a check on local law making.
- 4
Give two examples of local authority by-laws.
Model answer
A council may make a by-law banning drinking alcohol in a named public park. A council may also make a by-law controlling dogs on a beach.
- 5
Which bodies other than councils can make by-laws?
Model answer
Public corporations and transport bodies can make by-laws for their own premises and services. Railway and underground operators use by-laws to regulate passenger behaviour.
- 6
What did Kruse v Johnson [1898] decide about by-laws?
Model answer
Kruse v Johnson [1898] set the test for the reasonableness of a by-law made by an elected local body. The court held that such a by-law should be upheld unless it is manifestly unjust or oppressive.
