  1. 1

    What does Article 8(1) protect?

    Model answer

Article 8(1) protects the right to respect for private life, family life, home and correspondence. All four interests are protected separately, so a claim may engage only one of them.

  2. 2

What falls within private life under Article 8?

    Model answer

Private life covers physical and psychological integrity, personal identity, sexual life and personal information. Private life also extends to the relationships a person builds with the outside world.

  3. 3

What counts as family life under Article 8?

    Model answer

Family life covers the relationship between spouses and between parents and their children. Family life may also arise outside marriage where the ties are close and genuine.

  4. 4

What does home mean in Article 8?

    Model answer

Home means the place where a person actually lives, whether or not the occupation is lawful in domestic law. Business premises can also count as a home in some circumstances.

  5. 5

What does correspondence cover in Article 8?

    Model answer

Correspondence covers letters, telephone calls, emails and other private communications. Interception or reading of correspondence by a public body interferes with Article 8.

  6. 6

Which case ended the criminalisation of private homosexual conduct in Northern Ireland?

    Model answer

Dudgeon v United Kingdom (1981) held that criminalising private homosexual acts between consenting adults breached Article 8. The law in Northern Ireland was changed as a result.
