Each one with the model answer underneath.

  1. 1

Are judgments of the European Court of Human Rights binding?

    Model answer

A judgment binds the state that was party to the case, which undertakes to abide by it. The judgment does not automatically change domestic law.

  2. 2

Which body supervises the execution of judgments?

    Model answer

The Committee of Ministers of the Council of Europe supervises execution. The Committee monitors what a state has done and keeps a case open until satisfied.

  3. 3

What must a state do to execute a judgment?

    Model answer

A state must pay any just satisfaction awarded and take individual measures to remedy the applicant's position. General measures may also be required to prevent the violation recurring.

  4. 4

What is the difference between individual and general measures?

    Model answer

Individual measures address the applicant's own situation, such as reopening a case or releasing a detainee. General measures change the law or practice that produced the violation.

  5. 5

What happens if a state does not comply?

    Model answer

The Committee of Ministers may bring infringement proceedings referring the question back to the court. Ultimate sanctions are political, running to suspension or expulsion from the Council of Europe.

  6. 6

Why is enforcement ultimately political rather than legal?

    Model answer

The Convention system has no power to enforce a judgment inside a sovereign state. Compliance rests on the state's treaty obligation and on the political cost of open defiance.
