Questions from this subtopic
Each one with the model answer underneath.
- 1
What is specific performance?
Model answer
Specific performance is a court order compelling a party to carry out the contract. The order is available only where damages would be inadequate.
- 2
When are damages regarded as inadequate?
Model answer
Damages are inadequate where the subject matter is unique or no substitute can be obtained. Land is always treated as unique for this purpose.
- 3
Which case granted specific performance of a promise to pay an annuity?
Model answer
Beswick v Beswick [1968] ordered specific performance of a promise to pay a widow an annuity. Damages would have been nominal in a claim brought by the estate.
- 4
Can specific performance be ordered for a sale of goods?
Model answer
Falcke v Gray (1859) accepted that specific performance may be ordered for unique goods. Ordinary goods available in the market are compensated by damages.
- 5
Which case ordered continued supply during an oil shortage?
Model answer
Sky Petroleum Ltd v VIP Petroleum Ltd [1974] granted an injunction requiring continued supply of petrol. The buyer had no alternative supplier during the shortage, so damages were inadequate.
- 6
Why is specific performance refused for contracts of personal service?
Model answer
Compelling personal service would amount to forced labour and require constant policing. Damages are the remedy for breach of an employment contract.
